These Terms of Use (“Terms”) govern access to and use of homeschoolplatform.com, affiliated websites, hosted client websites, software tools, portals, and related services (collectively, the “Services”) provided by Homeschool Platform LLC (“Homeschool Platform,” “Company,” “we,” “our,” or “us”).

By accessing, purchasing, subscribing to, or using any portion of the Services, you agree to be bound by these Terms.

  1. Scope of Services

Homeschool Platform LLC provides website solutions, managed hosting, software tools, registration systems, payment integrations, member portals, dashboards, design services, consulting, content implementation, and related digital infrastructure primarily for homeschool co-ops, support groups, academies, microschools, state organizations, and related educational communities.

Unless otherwise stated in writing, Homeschool Platform is a technology, software, infrastructure, and service provider only and is not a school, educational institution, childcare provider, employer of instructors, payment processor, accredited institution, governmental educational agency, or operator of any client organization.

Homeschool Platform may provide software tools, dashboards, workflows, archival systems, reminders, forms, portals, organizational features, integrations, and related infrastructure intended to assist organizations with administration, communication, registration, recordkeeping, and operational management. Such tools are provided for organizational convenience only and do not constitute legal, financial, accreditation, tax, or regulatory advice.

  1. Eligibility and Authority

You represent that:

  • you are at least 18 years old;
  • you have authority to bind yourself or the organization you represent;
  • all information submitted to us is accurate and current; and
  • your use of the Services complies with applicable laws and regulations.

If you are using the Services on behalf of an organization, “you” includes that organization.

  1. Permitted Organizations and Jurisdiction

Homeschool Platform Services are intended solely for private, non-public educational organizations operating primarily within the United States.

By using the Services, you represent and warrant that:

  • your organization operates primarily within the United States;
  • your organization is not a public school district, governmental educational agency, publicly funded charter school, or state-operated institution;
  • your organization does not require Homeschool Platform to comply with public-school-specific vendor obligations applicable solely to governmental educational agencies; and
  • your organization is authorized to operate under applicable laws within its jurisdiction.

We reserve the right to deny, suspend, limit, or terminate Services for organizations that fall outside the intended scope of the platform.

  1. User Accounts and Security

We may provide administrator, staff, family, parent, student, instructor, or other account types.

You are responsible for:

  • maintaining the confidentiality of usernames and passwords;
  • restricting unauthorized access to your accounts;
  • ensuring account users are authorized;
  • all activity occurring under your credentials; and
  • promptly notifying us of suspected unauthorized access.

We reserve the right to suspend, disable, or terminate accounts for security, misuse, nonpayment, or violation of these Terms.

  1. Managed Hosting Requirement

Unless otherwise agreed in writing, all Homeschool Platform websites operate within our managed hosting environment.

Managed hosting may include infrastructure, updates, backups, maintenance, compatibility management, security monitoring, and related operational support.

Because our Services rely on integrated systems, managed hosting is required for continued access to certain proprietary features, templates, dashboards, workflows, and connected functionality.

  1. Fees, Billing, Renewals, and Nonpayment

Fees may include setup fees, recurring hosting fees, licensing fees, subscription fees, customization fees, consulting fees, support fees, transaction-related fees, and optional add-on charges.

By purchasing Services, you authorize us or our billing providers to charge applicable fees according to the selected billing schedule.

Unless otherwise stated in writing:

  • recurring services renew automatically by billing cycle;
  • invoices are due upon receipt;
  • late or failed payments may result in paused work or restricted access;
  • services may be suspended after delinquency;
  • continued nonpayment may result in cancellation or removal of hosted services.

You remain responsible for all outstanding balances accrued prior to cancellation.

  1. Third-Party Payment Processors

Some Services may integrate with third-party payment providers or e-commerce tools, including providers such as Stripe, PayPal, or similar services.

You acknowledge and agree that:

  • third-party processor fees are separate from Homeschool Platform fees;
  • processor fee schedules, reserves, holds, payout timing, disputes, chargebacks, and underwriting decisions are outside our control;
  • we are not a bank, money transmitter, escrow provider, or payment processor;
  • the connected merchant account owner remains responsible for processor compliance and transaction obligations unless expressly agreed otherwise in writing; and
  • we are not obligated to reimburse processor or transaction fees.

Your use of any third-party provider is also subject to that provider’s own terms and policies.

Certain Services may allow organizations to connect their own third-party merchant or payment processor accounts, including Stripe Connect accounts or similar integrations.

In such cases:

  • the organization remains the merchant of record for its own transactions;
  • payment transactions are processed directly through the organization’s connected payment account;
  • Homeschool Platform does not receive, hold, custody, or control customer payment funds;
  • Homeschool Platform is not a party to payment transactions between organizations and their members, families, customers, or users; and
  • organizations remain solely responsible for refunds, disputes, chargebacks, taxes, reporting obligations, processor compliance requirements, and transaction-related liabilities.

Payment card information is processed directly by the applicable payment processor and is not stored by Homeschool Platform except as necessary for limited integration functionality.

  1. Client Content and Data

You retain ownership of original content you submit, upload, or provide, including logos, text, photos, and organization data, subject to rights necessary for us to provide the Services.

You represent that you have all rights, permissions, and authority necessary to use and submit such content.

You are solely responsible for:

  • the legality and accuracy of your content;
  • obtaining required permissions or consents;
  • maintaining your own records where needed; and
  • your organization’s handling of member, family, or student information.

Organizations remain solely responsible for obtaining any required parental consents, notices, permissions, or authorizations relating to student or minor information uploaded, stored, or processed through the Services.

Homeschool Platform does not use student data for advertising purposes or AI model training.

  1. Proprietary Rights and License

All software, templates, systems, dashboards, workflows, designs, code, processes, branding, compilations, and materials created, owned, or licensed by Homeschool Platform are and remain the exclusive property of Homeschool Platform LLC or its licensors.

Except as expressly permitted in writing:

  • no ownership rights are transferred to you;
  • our systems are licensed, not sold;
  • proprietary assets may not be copied, exported, reverse engineered, resold, sublicensed, or transferred; and
  • access continues only during an active paid service relationship.
  1. Acceptable Use

You agree not to use the Services to:

  • violate any law or regulation;
  • infringe intellectual property or privacy rights;
  • distribute malware, spam, or harmful code;
  • harass, exploit, or endanger minors;
  • interfere with platform operations or security;
  • attempt unauthorized access;
  • engage in fraudulent or deceptive activity; or
  • use the Services in a manner that could expose us to liability.

We may investigate and take appropriate action for violations.

  1. Educational and Organizational Responsibility

Client organizations, leaders, instructors, and administrators remain solely responsible for their own operations, including where applicable:

  • curriculum decisions;
  • supervision and safety;
  • enrollment policies;
  • tuition or fee policies;
  • instructor relationships;
  • student records;
  • tax compliance;
  • legal compliance; and
  • communications with their members.

Homeschool Platform does not supervise educational programs or guarantee outcomes.

Organizations are solely responsible for determining and maintaining their own legal, educational, tax, filing, and operational classifications under applicable state law, including classifications relating to homeschool programs, umbrella schools, PSPs, private schools, learning centers, microschools, or related educational structures.

  1. Accreditation and Compliance Disclaimer

Homeschool Platform may provide tools, reminders, workflows, archival systems, organizational features, document storage, or tracking functionality intended to assist organizations with internal operations, filings, accreditation preparation, or recordkeeping activities.

However, Homeschool Platform does not provide accreditation services, legal advice, compliance determinations, governmental filings, regulatory certifications, or educational approvals.

Accreditation status, transcript issuance, state filing obligations, educational classifications, legal compliance, and any representations made to third parties remain solely the responsibility of the organization.

Organizations are solely responsible for independently verifying compliance with all applicable laws, regulations, filing requirements, accrediting-body standards, and operational obligations.

  1. Records Retention and Organizational Responsibility

Certain Services may include archival, export, retention, organizational, or recordkeeping-related functionality.

Such features are provided for convenience only and do not replace an organization’s independent legal, educational, tax, regulatory, or operational obligations.

Organizations remain solely responsible for maintaining records required by law and for determining appropriate retention schedules, filing obligations, and educational classifications under applicable state or federal law.

  1. Regulatory Scope

Unless expressly stated in writing, Homeschool Platform does not represent or warrant that the Services satisfy any particular governmental, accreditation, privacy, educational, or regulatory framework.

Organizations are responsible for independently determining whether the Services meet their own legal, operational, or compliance requirements.

  1. Custom Work, Timelines, and Revisions

Any timelines provided are estimates unless expressly guaranteed in writing.

Project schedules may be affected by client delays, missing materials, approval timing, third-party providers, legal reviews, technical constraints, or scope changes.

Reasonable revisions may be included where stated. Additional revisions, redesign requests, expanded scope, migrations, or new functionality may require additional fees.

  1. Data Export and Termination of Access

During an active relationship, certain data exports may be available. Proprietary systems, themes, templates, dashboards, workflows, or licensed tools are not transferable unless expressly stated in writing.

Upon cancellation or termination:

  • access may be limited or discontinued;
  • hosted systems may be disabled;
  • retained data may be deleted after a commercially reasonable period; and
  • recovery after deletion may not be possible.

We recommend maintaining independent copies of important records.

  1. No Warranties

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, or results from use of the Services.

We do not guarantee uninterrupted operation, error-free functionality, specific business results, enrollment growth, search rankings, payment approvals, third-party uptime, accreditation outcomes, regulatory compliance, or organizational eligibility determinations.

  1. Limitation of Liability

To the fullest extent permitted by law, Homeschool Platform LLC and its owners, officers, employees, contractors, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, data, or business opportunity arising from or related to the Services.

Our total aggregate liability for any claim arising out of or relating to the Services or these Terms shall not exceed the total amount actually paid by you to Homeschool Platform LLC during the twelve (12) months preceding the event giving rise to the claim.

  1. Indemnification

You agree to defend, indemnify, and hold harmless Homeschool Platform LLC and its owners, officers, employees, contractors, and affiliates from any claims, liabilities, damages, judgments, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • your use of the Services;
  • your content or data;
  • your organization’s operations;
  • your violation of these Terms; or
  • your violation of any law or third-party rights.
  1. Suspension and Termination

We may suspend or terminate access to any portion of the Services at our discretion for reasons including:

  • nonpayment;
  • suspected fraud;
  • security concerns;
  • abuse of staff;
  • violation of these Terms;
  • legal risk; or
  • operational necessity.

Termination does not waive outstanding payment obligations.

  1. Privacy

Your use of the Services is also subject to our Privacy Policy, as updated from time to time.

  1. Modifications to Services or Terms

We may modify, discontinue, or update the Services or these Terms at any time.

Updated Terms become effective when posted unless otherwise stated. Continued use after updates constitutes acceptance of the revised Terms.

  1. Governing Law and Venue

These Terms shall be governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

Any dispute arising from these Terms or the Services shall be brought exclusively in the state or federal courts located in Virginia, and you consent to such jurisdiction and venue.

  1. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

These Terms, together with any written proposal, invoice, order form, policy, or separate signed agreement we provide, constitute the entire agreement between the parties regarding the applicable Services.
