These Terms of Use (“Terms”) govern access to and use of homeschoolplatform.com, affiliated websites, hosted client websites, software applications, SaaS subscriptions, portals, dashboards, mobile-accessible services, proprietary platform tools, APIs, integrations, and related services (collectively, the “Services”) provided by Homeschool Platform LLC (“Homeschool Platform,” “Company,” “we,” “our,” or “us”).

By accessing, purchasing, subscribing to, or using any portion of the Services, you agree to be bound by these Terms.

1. Scope of Services

Homeschool Platform LLC provides website solutions, managed hosting, software tools, registration systems, payment integrations, member portals, dashboards, design services, consulting, content implementation, and related digital infrastructure primarily for homeschool co-ops, support groups, academies, microschools, state organizations, and related educational communities.

Unless otherwise stated in writing, Homeschool Platform is a technology, software, infrastructure, and service provider only and is not a school, educational institution, childcare provider, employer of instructors, payment processor, accredited institution, governmental educational agency, or operator of any client organization.

Homeschool Platform may provide software tools, dashboards, workflows, archival systems, reminders, forms, portals, organizational features, integrations, and related infrastructure intended to assist organizations with administration, communication, registration, recordkeeping, and operational management. Such tools are provided for organizational convenience only and do not constitute legal, financial, accreditation, tax, or regulatory advice.

2. Eligibility and Authority

If you purchase the Services or administer an organization’s account, you represent that:

  • you are at least 18 years old;
  • you have authority to bind yourself or the organization you represent;
  • all information submitted to us is accurate and current; and
  • your use of the Services complies with applicable laws and regulations.

If you are using the Services on behalf of an organization, “you” includes that organization.

Parents, guardians, students, instructors, staff, volunteers, and other people who receive access through a client organization (“Organization Users”) may use the Services only as authorized by that organization. A person under 18 may use the Services only with the permission of a parent or guardian and as authorized by the organization, and a child under 13 may use the Services only through an organization that has provided any required notice and obtained any required parental consent.

3. Permitted Organizations and Jurisdiction

Homeschool Platform Services are intended solely for private, non-public educational organizations operating primarily within the United States.

By using the Services, you represent and warrant that:

  • your organization operates primarily within the United States;
  • your organization is not a public school district, governmental educational agency, publicly funded charter school, or state-operated institution;
  • your organization does not require Homeschool Platform to comply with public-school-specific vendor obligations applicable solely to governmental educational agencies; and
  • your organization is authorized to operate under applicable laws within its jurisdiction.

We reserve the right to deny, suspend, limit, or terminate Services for organizations that fall outside the intended scope of the platform.

4. User Account and Security

We may provide administrator, staff, family, parent, student, instructor, or other account types.

You are responsible for:

  • maintaining the confidentiality of usernames and passwords;
  • restricting unauthorized access to your accounts;
  • ensuring account users are authorized;
  • all activity occurring under your credentials; and
  • promptly notifying us of suspected unauthorized access.

Organizations are responsible for the security of their own devices, networks, email accounts, and integrations; for turning on two-factor authentication for administrators and staff where the Services offer it; for assigning each user only the access they need; and for promptly removing access for people who leave the organization.

We reserve the right to suspend, disable, or terminate accounts for security, misuse, nonpayment, or violation of these Terms.

You authorize Homeschool Platform personnel to access your organization’s accounts and data as needed to provide support you request, maintain and secure the Services, investigate suspected misuse or security incidents, and comply with law, as described in our Data Processing Addendum.

5. Managed Hosting Requirement

Unless otherwise agreed in writing, all Homeschool Platform websites operate within our managed hosting environment.

Managed hosting may include infrastructure, updates, backups, maintenance, compatibility management, security monitoring, and related operational support.

Because our Services rely on integrated systems, managed hosting is required for continued access to certain proprietary features, templates, dashboards, workflows, and connected functionality.

6. Fees, Billing, Renewals, and Nonpayment

Fees may include setup fees, recurring hosting fees, licensing fees, subscription fees, customization fees, consulting fees, support fees, transaction-related fees, and optional add-on charges.

By purchasing Services, you authorize us or our billing providers to charge applicable fees according to the selected billing schedule.

Subscriptions renew annually on the anniversary of the original purchase date. The renewal amount includes the selected plan, capacity, and any recurring add-ons. One-time setup fees and one-time add-ons do not recur.

Storage and fair use: Each plan includes a storage allowance for files uploaded to the Services, shown in your account. You may add storage in blocks as a recurring add-on; added storage is billed for the remainder of the current subscription period and renews with your plan, and it may not be reduced or refunded mid-term. Storage is for files used to run your organization, such as documents, records, forms, and website images. It is not for general backup or archiving of unrelated files, bulk distribution of large media or video, or hosting files for use outside the Services. Uploads are not blocked automatically when you reach your allowance. If your organization stays over its allowance, or its storage or download activity is well beyond typical use for its plan, we will notify you and may ask you to remove files, add storage, or move to a larger plan. If the issue is not resolved within 30 days of that notice, we may restrict new uploads until it is. We will not delete your files for exceeding your allowance without first giving you notice and an opportunity to export them under Section 16.

You may cancel your subscription at any time before the next annual renewal is processed. Cancellation prevents the next renewal charge, and your paid access continues through the end of the current subscription period. Fees paid for the current period, setup, and purchased services are nonrefundable upon purchase, except as provided in Section 20 if we end a subscription without cause, in Section 22 if we discontinue the Services entirely, or where required by applicable law.

Unless otherwise stated in writing:

  • invoices are due upon receipt;
  • late or failed payments may result in paused work or restricted access;
  • services may be suspended after delinquency; and
  • continued nonpayment may result in cancellation or removal of hosted services.

You remain responsible for all outstanding balances accrued prior to cancellation.

7. Third-Party Payment Processors

Some Services may integrate with third-party payment providers or e-commerce tools, including providers such as Stripe and similar third-party payment providers.

You acknowledge and agree that:

  • third-party processor fees are separate from Homeschool Platform fees;
  • processor fee schedules, reserves, holds, payout timing, disputes, chargebacks, and underwriting decisions are outside our control;
  • we are not a bank, money transmitter, escrow provider, or payment processor;
  • the connected merchant account owner remains responsible for processor compliance and transaction obligations unless expressly agreed otherwise in writing; and
  • we are not obligated to reimburse processor or transaction fees.

Your use of any third-party provider is also subject to that provider’s own terms and policies.

Certain Services may allow organizations to connect their own third-party merchant or payment processor accounts, including Stripe Connect accounts or similar integrations.

In such cases:

  • the organization remains the merchant of record for its own transactions;
  • payment transactions are processed directly through the organization’s connected payment account;
  • Homeschool Platform does not receive, hold, custody, or control customer payment funds;
  • Homeschool Platform is not a party to payment transactions between organizations and their members, families, customers, or users; and
  • organizations remain solely responsible for refunds, disputes, chargebacks, taxes, reporting obligations, processor compliance requirements, and transaction-related liabilities.

Payment card information is processed directly by the applicable payment processor and is not stored by Homeschool Platform except as necessary for limited integration functionality.

Organizations that save payment methods, offer payment plans, or charge their families automatically through the Services are responsible for obtaining and keeping the payment authorizations required by card network rules, bank rules, and applicable law, for the terms of those plans, and for resolving billing questions and disputes with their families.

8. Client Content and Data

You retain ownership of original content you submit, upload, or provide, including logos, text, photos, and organization data, subject to rights necessary for us to provide the Services.

You represent that you have all rights, permissions, and authority necessary to use and submit such content.

You are solely responsible for:

  • the legality and accuracy of your content;
  • obtaining required permissions or consents;
  • maintaining your own records where needed; and
  • your organization’s handling of member, family, or student information.

Organizations remain solely responsible for obtaining any required parental consents, notices, permissions, or authorizations relating to student or minor information uploaded, stored, or processed through the Services.

Homeschool Platform does not use student data for advertising purposes or AI model training.

Organizations retain ownership of their customer, family, parent, student, enrollment, attendance, assignment, transcript, and organizational data. Homeschool Platform acts solely as a technology provider and data processor for purposes of providing the Services.

License to host your content: You grant Homeschool Platform a non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, display, back up, and adapt the content and data you and your users submit, only as needed to provide, secure, support, and improve the Services and as you direct, including publishing the content you place on public websites.

Sensitive information: Unless a feature of the Services is designed for it, organizations and their users may not upload or store Social Security numbers, full payment card or bank account numbers, driver’s license or other government identification numbers, passwords for other services, or detailed medical or health records. Organizations are responsible for any such information they choose to store.

Aggregated and de-identified data: Homeschool Platform may create and use aggregated or de-identified information about how the Services are used, such as feature usage, performance, and system metrics, to operate, secure, and improve the Services. That information will not identify an organization or individual, will not be used for advertising, and will not include student data used to train artificial intelligence models.

Feedback: If you give us suggestions or feedback about the Services, we may use them without restriction or obligation to you.

Backups: Backups are kept for disaster recovery and security, not as a records service. We are not obligated to restore individual records, files, or content from backups on request, and organizations should keep their own copies of important records.

Legal requests: We may access, preserve, or disclose information when we believe in good faith that it is required by law, subpoena, court order, or other legal process, or necessary to protect the Services, our users, or others. Where legally permitted and practical, we will notify the affected organization so it can seek a protective order or other remedy.

9. Proprietary Rights and License

All software, templates, systems, dashboards, workflows, user interfaces, designs, code, processes, branding, compilations, documentation, training materials, proprietary methodologies, APIs, platform functionality, and other materials created, owned, licensed, or provided by Homeschool Platform are and remain the exclusive property of Homeschool Platform LLC or its licensors.

Except as expressly permitted in writing:

  • no ownership rights are transferred to you;
  • our Services, software, systems, and proprietary materials are licensed, not sold;
  • proprietary assets may not be copied, reproduced, modified, reverse engineered, decompiled, disassembled, exported, resold, sublicensed, leased, assigned, distributed, or transferred;
  • you may not create, publish, distribute, license, sell, monetize, or otherwise commercialize tutorials, training courses, instructional videos, consulting services, documentation, or other materials based upon or derived from the Services or proprietary platform functionality without our prior written consent;
  • you may not use the Services, proprietary workflows, platform functionality, documentation, or knowledge gained through access to the Services to develop, market, support, promote, benchmark, or assist any competing software, platform, product, or service; and
  • access to proprietary features, software, and platform functionality continues only during an active paid service relationship.

Clients may not record, reproduce, publish, or distribute non-public portions of the platform, including its dashboards, workflows, or training materials, without our prior written agreement. This includes recordings intended for internal training. Homeschool Platform provides client training and may separately agree to create or authorize additional training materials.

Any exception must be documented in a written agreement that identifies the permitted recording or materials, their intended audience and use, the effective and expiration dates, and a point of contact for each party.

Templates, designs, forms, and printable layouts: Templates and designs that Homeschool Platform provides or creates for an organization are licensed to the organization only for use on the Services while its subscription is active. This includes website templates, themes, layouts, and section designs; form templates, such as registration, application, and inquiry forms; PDF and printable layouts, such as transcripts, report cards, certificates, ID cards, rosters, invoices, and receipts; email templates; and other design work. An organization may not copy, export, reproduce, or recreate them, or create websites, forms, documents, or other materials in their likeness, whether on its own or with any third party, including a web designer, agency, or other platform, during or after its subscription. When an organization stops using the Services, its license to them ends. The organization keeps its own content, such as its text, photos, logos it supplied, and the information in its records, and may use that content anywhere. Documents already issued from the Services, such as a transcript given to a student or an invoice sent to a family, remain usable as records, but their layouts may not be reused to produce new documents. A logo we design for an organization as a purchased logo design service belongs to that organization once it is paid for in full.

Our name, logos, and website: Homeschool Platform’s name, logos, trademarks, branding, website, and marketing materials, including the text, images, screenshots, videos, and designs on homeschoolplatform.com, belong to Homeschool Platform. Using them for an organization’s own marketing, advertising, or promotion, or in any way that suggests a partnership, endorsement, or affiliation, is strictly prohibited. The only permitted use is the Homeschool Platform attribution that the Services display, described below.

Homeschool Platform attribution: Homeschool Platform may display attribution such as “Made with Homeschool Platform” or “Powered by Homeschool Platform,” including our name, logo, and a link, on any product or service we provide, including organization websites, portals, forms, emails, and PDF or printable documents. An organization may not remove, hide, alter, or obscure that attribution unless its plan or a written agreement with us allows it.

No claiming the Services as your own: An organization may not claim or suggest that it created, owns, operates, or provides the Services or the technology behind them, or present the Services, its website’s platform, or any feature of them as its own product or service. An organization may describe its programs and its own website content as its own.

Customer references: Homeschool Platform may identify an organization as a customer, including by name and logo, on its website and in its marketing materials. An organization may ask us to stop at any time by emailing legal@homeschoolplatform.com, and we will remove its name and logo from materials we control within a reasonable time.

No replication of the platform: An organization may not replicate, clone, or imitate the Services, or build, commission, or help build any software, website, platform, or service that copies or is substantially similar to the Services’ features, workflows, dashboards, user interface, forms, documents, or design, whether on its own or with any third party, during or after its subscription.

Unauthorized reproduction, publication, distribution, commercialization, or disclosure of proprietary platform content or functionality may constitute infringement of Homeschool Platform’s intellectual property rights and may result in suspension or termination of access, legal action, and any other remedies available under applicable law.

10. Acceptable Use

You agree not to use the Services to:

  • violate any applicable law or regulation;
  • infringe upon the intellectual property, privacy, or other rights of any person or entity;
  • distribute malware, spam, viruses, or other harmful code;
  • harass, exploit, abuse, or endanger minors;
  • interfere with, disrupt, or compromise the operation, security, or integrity of the Services;
  • attempt unauthorized access to any account, system, network, or data;
  • engage in fraudulent, deceptive, or unlawful activity;
  • abuse the Services, including by overloading them, sending automated or excessive requests, scraping or harvesting data, or using bots or scripts not provided by us;
  • circumvent plan limits, feature restrictions, usage caps, security measures, or access controls;
  • resell, sublicense, rent, lease, or white-label the Services, offer them or websites, portals, or other materials built with them to any other organization or person, or share access or login credentials with anyone outside the organization;
  • probe, scan, or test the vulnerability of the Services without our written authorization;
  • harass, threaten, or abuse Homeschool Platform staff;
  • give any third party, such as a vendor, developer, consultant, or other platform, access to the Services or to your accounts, other than your own authorized users;
  • connect, integrate, or link any third-party software, API, automation, script, or service to the Services, except integrations we provide or approve in writing;
  • place or allow advertisements on websites, pages, forms, emails, or other materials created or delivered through the Services, including ad networks, paid banner or display ads, and affiliate links;
  • use the Services, including websites, forms, emails, or other materials created or delivered through them, to promote, advertise, recommend, or link to software, platforms, or services that compete with the Services;
  • make or publish false or misleading statements of fact about Homeschool Platform or the Services that you know, or reasonably should know, are untrue; or
  • use the Services in any manner that could expose Homeschool Platform to legal liability or reputational harm.

We reserve the right to investigate suspected violations and take any action we deem appropriate, including immediate suspension or termination of access without a refund.

An organization may acknowledge its own sponsors, donors, and community partners on its website, such as by name, logo, and a link, as long as the listing does not promote software, platforms, or services that compete with the Services.

Nothing in these Terms restricts your right to share honest reviews, opinions, or feedback about Homeschool Platform or the Services.

Reporting security vulnerabilities: If you discover a security vulnerability in the Services, report it promptly to legal@homeschoolplatform.com and do not access, change, or disclose other people’s data, disrupt the Services, or publicize the issue before we have had a reasonable opportunity to fix it. We will not pursue legal action against good-faith research that follows these rules.

Unauthorized access, attacks, and disruption: Access to the Services is authorized only for people using an account we or a client organization provided, and only within the permissions of that account. Any other access or attempted access, and any attempt to disrupt, degrade, or overwhelm the Services, is unauthorized. This includes exploiting vulnerabilities; bypassing authentication, access controls, or plan limits; using stolen or guessed credentials; injecting malicious code; flooding the Services with traffic, requests, sign-ups, messages, or form submissions; denial-of-service attacks; automated scraping; and accessing other organizations’ data. Such conduct may violate the federal Computer Fraud and Abuse Act and state computer-crime laws. These rules apply to everyone, including an organization’s owners, operators, administrators, staff, and volunteers, and parents, guardians, students, and other Organization Users. We log and monitor activity on the Services, including IP addresses, devices, and requests, to detect and investigate such conduct. We may block, suspend, or terminate any account, device, network, or organization involved without notice or refund; preserve evidence; refer the matter to law enforcement and cooperate with any investigation; and pursue the civil and criminal remedies available against the people responsible.

11. Educational and Organizational Responsibility

Client organizations, leaders, instructors, and administrators remain solely responsible for their own operations, including, where applicable:

  • curriculum decisions;
  • supervision and student safety;
  • enrollment policies;
  • tuition and fee policies;
  • instructor relationships;
  • student records;
  • tax compliance;
  • legal compliance; and
  • communications with their members.

Homeschool Platform does not supervise educational programs, employ instructors, or guarantee educational, operational, or organizational outcomes.

Organizations remain solely responsible for determining and maintaining their own legal, educational, tax, filing, and operational classifications under applicable law, including classifications relating to homeschool programs, umbrella schools, PSPs, private schools, learning centers, microschools, and similar educational organizations.

Representations to families and the public: Each organization is solely responsible for every statement, promise, and representation it makes to its members, families, students, staff, and the public, including program descriptions, schedules, pricing, tuition and refund policies, safety practices, instructor qualifications, accreditation or approval status, outcomes, and website content. This applies even when those statements appear on a website hosted by Homeschool Platform or at a Homeschool Platform web address, or are sent through the Services. Homeschool Platform does not review, verify, or endorse an organization’s statements and is not a party to its relationships with its members and families.

Forms, documents, and templates generated by the Services: The Services may create or pre-fill content for an organization, including registration and application forms, agreements and waivers, invoices, receipts, payment plans, transcripts, report cards, certificates, attendance and grade reports, emails and notifications, and website templates and default text. These are tools, not legal, educational, or financial advice. The organization is responsible for reviewing, customizing, and approving that content before using it, and for its accuracy, legal sufficiency, and effect, in the same way as content the organization writes itself.

12. Accreditation and Compliance Disclaimer

Homeschool Platform may provide tools, reminders, workflows, archival systems, organizational features, document storage, tracking functionality, or similar features intended to assist organizations with internal administration, filings, accreditation preparation, or recordkeeping.

However, Homeschool Platform does not provide:

  • accreditation services;
  • legal advice;
  • compliance determinations;
  • governmental filings;
  • regulatory certifications; or
  • educational approvals.

Accreditation status, transcript issuance, state filing obligations, educational classifications, legal compliance, and representations made to third parties remain solely the responsibility of each organization.

Organizations are solely responsible for independently verifying compliance with all applicable laws, regulations, filing requirements, accrediting-body standards, and operational obligations.

13. Records Retention and Organizational Responsibility

Certain Services may include archival, export, retention, organizational, or recordkeeping functionality.

Such functionality is provided solely for organizational convenience and does not replace an organization’s independent legal, educational, tax, regulatory, or operational responsibilities.

Organizations remain solely responsible for maintaining records required by law and determining appropriate retention schedules, filing obligations, and educational classifications under applicable federal, state, or local law.

Homeschool Platform is not a records custodian for any organization. Once an organization’s paid subscription period and the export-request period in Section 16 have ended, Homeschool Platform has no obligation to retain, store, or produce the organization’s records for any retention period, including periods required of the organization by law. Organizations that must keep student, attendance, academic, financial, or other records for a set number of years are responsible for exporting and keeping those records themselves.

14. Regulatory Scope

Unless expressly stated in writing, Homeschool Platform does not represent or warrant that the Services satisfy any specific governmental, accreditation, educational, privacy, legal, or regulatory framework.

Organizations are solely responsible for determining whether the Services meet their own legal, operational, educational, privacy, or compliance requirements.

15. Custom Work, Timelines, and Revisions

Any timelines provided are estimates unless expressly guaranteed in writing.

Project schedules may be affected by client delays, missing materials, approval timing, third-party providers, legal review, technical limitations, or changes in project scope.

Where applicable, reasonable revisions may be included as specified in a proposal or agreement.

Additional revisions, redesign requests, expanded scope, migrations, integrations, consulting, or new functionality may require additional fees.

16. Data Export and Termination of Access

During an active subscription, the organization’s authorized account administrator may request an export of eligible organizational data by emailing legal@homeschoolplatform.com. The administrator may also submit an export request within 30 calendar days after the paid subscription period ends. Requests must identify the organization and a current point of contact authorized to receive the data.

We will provide available eligible data in the export formats we support. An export does not include Homeschool Platform software, website themes, templates, proprietary workflows, or licensed features. After the 30-day request period, data may no longer be available for export. We recommend requesting an export before the subscription ends and maintaining independent copies of important records.

After the paid subscription period ends, Homeschool Platform is not responsible for maintaining, updating, or reconciling the organization’s records. Data remaining in the Services is not the organization’s official record, and an export reflects data only as of the date it is prepared. If the organization continues its records in another system, the organization is solely responsible for the accuracy and completeness of those records, for identifying which records are official, and for informing its members and families, including if the organization stops using the Services or closes. Homeschool Platform does not contact an organization’s members or families about these matters. Until data remaining in the Services is deleted, Homeschool Platform will continue to protect it as described in the Privacy Policy and Data Processing Addendum.

17. No Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “AS IS” and “AS AVAILABLE” basis.

Homeschool Platform disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and results obtained from use of the Services.

We do not guarantee uninterrupted operation, error-free functionality, enrollment growth, search rankings, payment approvals, third-party availability, accreditation outcomes, legal compliance, regulatory compliance, or organizational eligibility.

Features described as planned, upcoming, in development, or in beta may change, be delayed, or not be released. Purchases are based on the features available at the time of purchase, not on the future availability of any feature, unless we expressly agree otherwise in writing.

18. Limitation of Liability

To the fullest extent permitted by law, Homeschool Platform LLC and its owners, officers, employees, contractors, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including any loss of profits, revenue, goodwill, data, business opportunity, or business interruption arising from or relating to the Services.

Without limiting the paragraph above, and to the fullest extent permitted by law, Homeschool Platform is not liable for financial losses arising from the operation or failure of the Services, including errors in invoices, fees, discounts, balances, or calculations; failed, delayed, missed, duplicate, or incorrect charges, payments, refunds, or payouts; automatic charges or payment plans; lost tuition, revenue, or enrollments; late fees; or downtime or outages of the Services or of third-party payment, banking, hosting, or email providers. Organizations are responsible for reviewing their invoices, payment plans, charges, and payouts and for reconciling them with their payment processor.

Security incidents: To the fullest extent permitted by law, Homeschool Platform is not liable for unauthorized access to, or loss, disclosure, or alteration of, an organization’s or its users’ information that results from causes outside our reasonable control or from the actions of the organization, its users, or third parties, including compromised, shared, or weak passwords; phishing or other social engineering; malware or compromised devices; access permissions an organization assigns; information an organization or its users download, export, print, email, or share outside the Services; or incidents at third-party hosting, payment, email, or other providers. Any other liability relating to a security incident is subject to the limits in this Section. We will still meet our security and notification commitments in our Data Processing Addendum and any obligations that applicable law does not allow us to waive.

Our total aggregate liability arising from or relating to the Services or these Terms shall not exceed the total amount actually paid by you to Homeschool Platform during the twelve (12) months immediately preceding the event giving rise to the claim.

19. Indemnification

You agree to defend, indemnify, and hold harmless Homeschool Platform LLC and its owners, officers, employees, contractors, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to:

  • your use of the Services;
  • your content or data;
  • your organization’s operations;
  • your violation of these Terms;
  • your violation of applicable law or the rights of any third party;
  • any claim by your members, families, students, staff, volunteers, or other Organization Users relating to your organization, its programs, its statements or representations, its payments and refunds, or content and forms it uses through the Services; or
  • any unauthorized access, attempted access, attack, disruption, or security incident caused by you or your users, including our investigation, remediation, notification, and legal costs.

If unauthorized access, an attack, or disruption of the Services is carried out or attempted by anyone who received access through an organization, the person responsible, and the organization under this Section, are responsible for the resulting damages and costs described in Section 10.

20. Suspension and Termination

We may suspend, restrict, or terminate access to any portion of the Services at our discretion for reasons including:

  • nonpayment;
  • suspected fraud;
  • security concerns;
  • abuse of staff;
  • violation of these Terms;
  • legal or regulatory risk; or
  • operational necessity.

We may also end an organization’s subscription at any time, for any reason, by notice to its designated account contact. If we end a subscription for a reason other than nonpayment, suspected fraud, abuse of staff, a violation of these Terms, or legal or regulatory risk, we will refund the unused portion of any prepaid subscription fees for the period after access ends, and the organization may request an export of its data as described in Section 16.

Termination does not waive any outstanding payment obligations or other accrued liabilities.

21. Privacy

Your use of the Services is also governed by our Privacy Policy, as amended from time to time, which is incorporated into these Terms by reference.

22. Modifications to Services or Terms

We may modify, suspend, or update the Services or these Terms at any time. If we discontinue the Services entirely, the discontinuation terms below apply.

Discontinuation of the Services: If we decide to discontinue the Services entirely, we will notify each organization’s account contact by email at least 60 days before the discontinuation date, unless circumstances beyond our reasonable control prevent it. During that notice period, and for 30 calendar days after the discontinuation date where reasonably practicable, the organization’s authorized account administrator may request an export of eligible organizational data as described in Section 16. We will refund the unused portion of any prepaid subscription fees covering the period after the discontinuation date. This refund does not apply to setup fees, one-time add-ons, or services already performed, or when access ends because of nonpayment, a breach of these Terms, or suspension under Section 20. Each organization is responsible for informing its own members and families.

Transfer of the business: Each organization agrees that, in a merger, acquisition, reorganization, financing, or sale of all or part of our business or assets, Homeschool Platform may transfer the organization’s account, these Terms, and all of its data and records, including family and student records, to the successor without further consent. The successor must be bound by privacy and data-protection commitments at least as protective as our Privacy Policy and Data Processing Addendum, and we will notify affected organizations of the transfer.

Updated Terms become effective upon posting unless otherwise stated.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.

23. Organization Users and Families

Organization Users receive access to the Services through their organization. Their relationship, including enrollment, tuition, payments, refunds, programs, supervision, communications, and records, is with that organization, not with Homeschool Platform. Organizations are responsible for:

  • deciding who receives access, and removing access when appropriate;
  • making sure their Organization Users follow these Terms, including Section 10 (Acceptable Use);
  • providing their Organization Users any notices, policies, and agreements required by law or by the organization, including notice that the organization uses service providers such as Homeschool Platform;
  • handling questions, requests, complaints, and disputes from their Organization Users; and
  • supervising how students and minors use messaging, community, and other interactive features.

Homeschool Platform does not market to, solicit, or contact Organization Users, other than automated transactional messages needed to operate their accounts, such as password resets and sign-in or security notices. Messages sent through the Services, including from Homeschool Platform email or web addresses, are sent on the organization’s behalf.

Organization Users who contact Homeschool Platform about their organization will be referred to that organization. To the fullest extent permitted by law, Homeschool Platform has no liability to Organization Users for the acts, omissions, statements, programs, content, or decisions of their organization, and Organization Users’ access may be suspended or ended by their organization or by us under Section 20.

Reporting abuse and unlawful conduct: Each organization is solely responsible for identifying and reporting suspected abuse, neglect, exploitation, threats, or other unlawful conduct involving its students, families, staff, or volunteers to law enforcement, child protective services, or other authorities, as required by mandated-reporter and other applicable laws. Homeschool Platform does not monitor organizations or their users for such conduct and does not report on an organization’s behalf. Homeschool Platform may, however, report to or cooperate with law enforcement or other authorities where required by law, including reporting apparent child sexual abuse material, or where we believe in good faith that doing so is necessary to protect someone from harm.

25. Notices and Electronic Communications

Each organization must maintain a current designated account contact — by default, the owner or primary administrator of its account — and keep that contact’s email address up to date. Notices from Homeschool Platform to an organization, including notices about renewals, changes to these Terms or our Data Processing Addendum, subprocessors, security incidents, and discontinuation, are given by email to that contact and are effective when sent.

You agree to receive communications from us electronically, and agree that electronic notices, agreements, and records satisfy any requirement that they be in writing. Notices to Homeschool Platform must be sent to legal@homeschoolplatform.com.

26. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located within the Commonwealth of Virginia.

You consent to the personal jurisdiction and venue of such courts.

27. General Terms

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, Data Processing Addendum (where applicable), written proposals, invoices, order forms, policies, and any separate written agreements between the parties, constitute the entire agreement governing the applicable Services and supersede all prior discussions or understandings relating to those Services.

Assignment: You may not assign, sell, transfer, or give these Terms, your subscription, or your account, including ownership or control of the account, to any other organization or person, including as part of a sale, merger, or change of control of your organization, without our prior written consent. Any attempted transfer without consent is void. A change of the account owner or administrators within the same organization is not a transfer and can be requested through support. We may assign or transfer these Terms, your account, and your data and records as described in Section 22.

New organizations and new ownership: Every new organization must open its own account and subscription and accept all of these Terms, the Privacy Policy, and the Data Processing Addendum. If an organization is sold, merged, or comes under new ownership, management, or control, each new owner or operator must open a new account and subscription and accept all of those terms, and is also bound by all terms, acknowledgments, and obligations the previous owner or operator accepted for the organization, including payment responsibility terms, consents, and any amounts owed. The existing account, subscription, and any prepaid fees do not carry over. All responsibility and liability relating to the organization, its programs, families, students, staff, records, payments, and use of the Services, including anything arising before the change, rests with the continuing organization and its new owners and operators, together with any prior owner or operator as between themselves. Homeschool Platform has no liability for disputes between current and former owners, operators, or administrators about an organization’s account, data, records, websites, or funds. At our discretion, and only with written authorization from the existing account owner, we may move eligible data from the existing account into the new one, which may be subject to a fee.

Force majeure: We are not responsible for delays or failures caused by events beyond our reasonable control, including outages of third-party hosting, network, payment, or email providers, natural disasters, government actions, labor disputes, or cyberattacks.

Survival: Provisions that by their nature should continue after termination survive, including those on fees owed, proprietary rights, records and data export, disclaimers, limitation of liability, indemnification, governing law, and these General Terms.

No waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
